Welcome to the website of The King's Refuge ("TKR," "we," "us," or "our"). TKR is a 501(c)(3) nonprofit, Christ-centered ministry dedicated to equipping and guiding believers through Biblical Counseling, Outdoor Adventures, and Leadership Development. Our mission is to foster spiritual maturity, integrity, and Biblically integrated living in men and women across Northwest Arkansas and beyond.
These Terms and Conditions ("Terms") govern your access to and use of the TKR website (the "Site"), including any content, functionality, and services offered on or through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Site. We reserve the right to modify these Terms at any time, and continued use of the Site after changes constitutes acceptance of the updated Terms. We will notify you of material changes by posting the new Terms on the Site with an updated effective date.
1. Eligibility
You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you meet this eligibility requirement and that you have the legal capacity to agree to these Terms. The Site is intended for users in the United States; access from other jurisdictions is at your own risk, and you are responsible for compliance with local laws.
2. Use of the Site
Permitted Use
The Site provides general information about TKR's programs in Biblical Counseling (offering Scripture-based guidance for spiritual and emotional growth), Outdoor Adventures (facilitating transformative experiences in nature), and Leadership Development (equipping believers for faithful service). You may use the Site for personal, non-commercial purposes, such as learning about our mission, exploring services, or accessing resources.
Prohibited Activities
You agree not to:
Use the Site for any illegal, harmful, or unauthorized purpose. Interfere with the Site's operation, including by introducing viruses, engaging in denial-of-service attacks, or scraping content without permission. Post, upload, or transmit any defamatory, obscene, hateful, or infringing material (though user-generated content is not currently enabled). Impersonate any person or entity, or misrepresent your affiliation with TKR. Collect or store personal data about other users without consent. Violate any applicable law or these Terms.
We reserve the right to terminate or suspend your access to the Site for any violation of these Terms, at our sole discretion.
3. Donations
The Site includes links to facilitate donations to TKR. All donations are voluntary and processed through secure third-party payment processors (e.g., PayPal or Stripe). By donating, you acknowledge that: Donations are irrevocable once processed. As a 501(c)(3) organization, contributions may be tax-deductible to the extent allowed by law; consult your tax advisor for details. We do not store your payment information; all transactions are governed by the processor's terms. TKR reserves the right to refuse any donation at our discretion.
Donation receipts will be provided via email or upon request, in compliance with IRS guidelines.
4. Third-Party Links and Resources
The Site contains links to external websites, resources, and materials (e.g., articles, videos, or partner sites) that may provide additional support for Biblical Counseling, Outdoor Adventures, or Leadership Development. These links are provided for convenience only and do not necessarily imply endorsement by TKR. We have no control over the content, privacy practices, or availability of third-party sites. Accessing them is at your own risk, and you should review their terms and policies before use. TKR disclaims all liability for any loss or damage arising from your interaction with third-party content.
5. Intellectual Property Rights
All content on the Site, including text, graphics, logos, images, videos, and program descriptions (collectively, "TKR Content"), is the property of TKR or its licensors and protected by U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from TKR Content without our prior written consent. Limited permission is granted to view and print TKR Content for personal, non-commercial use, provided you retain all copyright notices.
If you believe any TKR Content infringes your rights, please contact us as described in Section 11. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown notices.
6. User Content
The Site does not currently allow user submissions (e.g., comments or uploads). If this changes, any content you provide will be subject to a non-exclusive, royalty-free license to TKR for use in promoting our mission. You represent that your content does not violate third-party rights or these Terms.
7. Disclaimers
The Site and TKR Content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, completeness, or timeliness of information on the Site, including details about our programs. Biblical Counseling and other services are faith-based and not a substitute for professional medical or psychological advice; consult qualified professionals for health-related concerns.
Outdoor Adventures involve inherent risks; participants must review and sign waivers before engaging.
We do not warrant that the Site will be error-free, secure, or uninterrupted, or that any defects will be corrected.
8. Limitation of Liability
To the fullest extent permitted by law, TKR, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if advised of the possibility of such damages. Our total liability shall not exceed $100 or the amount you paid us in the past 12 months (if any). This limitation applies to all claims, including those related to donations, third-party links, or program information.
9. Indemnification
You agree to indemnify, defend, and hold harmless TKR and its affiliates from any claims, losses, or damages arising from your violation of these Terms, misuse of the Site, or infringement of third-party rights.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Washington County, Arkansas. You agree to submit to the personal jurisdiction of such courts.
We encourage informal resolution first: Contact us with concerns before pursuing legal action. Binding arbitration may be required for certain claims under applicable law.
11. Changes to the Site and Termination
We may update, suspend, or discontinue any part of the Site at any time without notice. Upon termination of your access, these Terms will continue to apply to your prior use.
12. Miscellaneous
Severability: If any provision is held invalid, the remainder remains in effect.
No Waiver: Our failure to enforce any right does not waive it.
Entire Agreement: These Terms, along with our Privacy Policy, constitute the full agreement.
Force Majeure: We are not liable for delays due to events beyond our control.
